Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and 1948 ("we," "us," or "our") governing your access to and use of the 1948 mobile application (the "App").

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • Your use of the App does not violate any applicable law or regulation
  • All information you provide is accurate and complete

Description of Service

1948 is a mobile application that provides tennis match schedules, tournament information, player statistics, and prediction features for entertainment purposes. The App includes:

  • Tennis match schedules and calendar views
  • Tournament draws and brackets
  • Player profiles and statistics
  • Match prediction features for entertainment
  • Match results and scores

The prediction features are provided solely for entertainment purposes. No actual betting or gambling functionality is included in this App.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal mobile device
  • Use the App for your personal, non-commercial purposes

This license does not include the right to:

  • Modify, copy, distribute, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices from the App
  • Use the App for any commercial purpose without our prior written consent

User Conduct

When using the App, you agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the App or its related systems
  • Interfere with or disrupt the App's operation or servers

Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and design) are owned by 1948 or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Tennis match data, player information, and tournament details may be provided by third-party sources and remain the property of their respective owners.

Third-Party Content and Services

The App may display content from third-party sources and may contain links to third-party websites or services. We do not control and are not responsible for:

  • The accuracy, completeness, or reliability of third-party content
  • The privacy practices or terms of third-party services
  • Any transactions you conduct with third parties

Your use of third-party services is at your own risk and subject to their respective terms and policies.

Data Accuracy and Availability

While we strive to provide accurate and up-to-date tennis information, we make no warranties regarding:

  • The correctness of player statistics or rankings
  • The availability of the App at all times
  • The reliability of real-time data updates

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT

We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 1948 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Cost of substitute goods or services
  • Any damages arising from your use of the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless 1948 and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit through the App

Modifications to the App and Terms

We reserve the right to:

  • Modify, suspend, or discontinue the App at any time without notice
  • Update these Terms at any time by posting the revised version
  • Change features or functionality of the App

Your continued use of the App after any changes constitutes acceptance of the modified Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

  • Your license to use the App will immediately cease
  • You must delete all copies of the App from your devices
  • Provisions that should survive termination will remain in effect

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1948 regarding your use of the App and supersede all prior agreements and understandings.
